Welcome to MBASurf, operated by Continuvo Ventures (“Company”, “we”, “us”, or “our”). By accessing or using our website at mbasurf.com and any associated services, tools, or content (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.

MBASurf provides MBA application coaching, essay guidance, story development, school selection strategy, interview preparation, and related educational consulting services. Our Services are delivered through an online platform that includes AI-powered tools, expert coaching, and educational content.

3. Registration and Account

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age or the age of majority in your jurisdiction to use our Services. Each user may register only once and create only one account. Accounts are for personal use only and may not be shared with or transferred to third parties.

4. Payment and Billing

Certain aspects of our Services require payment of fees. All fees are stated in the currency specified at the time of purchase and are exclusive of applicable taxes unless otherwise stated. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

We reserve the right to change our pricing at any time. Any changes to pricing will not affect active subscriptions or services already purchased. Prices for new subscriptions or renewals will be at the then-current rates.

5. Refund Policy

All payments made for our Services are final and non-refundable. By purchasing our Services, you acknowledge and agree that we do not offer refunds or credits for any amounts paid, including for partial use of the Services or for any unused portion of a service period. 6. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations;
• Attempt to gain unauthorized access to any part of the Services, accounts, or systems;
• Upload or transmit viruses, malware, or any harmful code;
• Interfere with or disrupt the integrity or performance of the Services;
• Use any automated means (bots, scrapers, etc.) to access or interact with the Services without our express permission;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Share, resell, or redistribute access to the Services or any content obtained through the Services.

7. Intellectual Property

All content, materials, features, and functionality available through the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the property of Continuvo Ventures or its licensors and are protected by applicable intellectual property laws.

You retain ownership of any essays, documents, or other content you submit through the Services (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display such content solely for the purpose of providing and improving our Services to you.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Continuvo Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Services.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim. This limitation of liability applies regardless of the legal theory under which the claim is brought.

9. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We make no guarantee regarding the results or outcomes of using our coaching services, including but not limited to MBA admissions results.

MBASurf provides educational guidance and coaching. We do not guarantee admission to any educational institution, nor do we make any representations regarding the likelihood of acceptance. Results vary based on numerous factors beyond our control.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Any fees paid prior to termination are non-refundable.

You may terminate your account at any time by contacting us at support@mbasurf.com. Termination of your account does not relieve you of any payment obligations incurred prior to termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website. We will notify you of material changes via email or through a notice on our website. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

12. Privacy

13. Governing Law
